We may change or update our privacy policy from time to time. It is important that the personal data we hold about you is accurate and up to date. please keep us informed if your personal data changes during your relationship with us.

2. THE PERSONAL DATA WE COLLECT

The types of personal data we collect, use and retain depend on the product or service you have requested from us and/or the nature of your interaction with us. When you use the Platform, we collect and process the following types of personal data: your name, phone number, and credit/debit card details; personal, device and business contact information; login and account information (including mobile number, password and unique user ID); location data (including location, date and time a mobbi powerbank was taken and returned, locations and preferences you send); payment or credit card information; technical information (including the type of mobile device used, a unique device identifier (e.g., the IMEI number of the device, the MAC address of the device’s wireless network interface, or the mobile number used by the device), mobile network information, your mobile operating system, the type of mobile browser used and time zone setting) your communication and marketing preferences; your interests, preferences, feedback and survey responses; other personal data that you submit to us, such as information you provide to register, text message alerts or correspond with us in connection with requests; and other publicly available personal data, including personal data that you have shared via a public platform (such as a Twitter feed, Instagram or public Facebook page).

The Platform is not intended for children and we do not knowingly collect or solicit data from anyone under the age of 18. We do not collect special category personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetics and biometric data ). Nor do we collect any information about criminal convictions and offences.

3. HOW WE OBTAIN YOUR PERSONAL DATA

Information that you provide to us

We collect information that you provide to us directly through the online platform, i.e. through conversations with the call centre and correspondence including by email.

Information obtained from other sources

We will automatically collect data that you use to access services through the platform. This information includes information relating to your device, as well as location information (if you have allowed us to collect such information).

We also work closely with third parties (including, for example, business partners, subcontractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and we will inform you when we receive information about you from them and the purposes for which we intend to use it. We may combine the personal information you provide to us with information we collect from or about you in certain circumstances. This will include information collected online or offline.

4. HOW WE USE YOUR PERSONAL DATA

We will use your personal data for the following purposes and provided it is legally possible:

To enter into and execute contracts with you, including sending you welcome text messages and periodic text messages providing details of how to use our service and mobile phone, concerning the administration of your account (e.g. “top up your account”); building a profile of your preferences so that we can ensure that our services are provided when you need them; processing payments for the services we provide; and processing payment of fees for using Mobbi powerbanks. To track pick-up and drop-off locations and where the nearest Mobbi power stations are to you. That is, if it is necessary to protect our legitimate interests, such as tracking our powerbanks that we rent.

To manage our relationship with you, including if

(a) we inform you of charges to our terms or ask you to leave a review or take a survey

(b) If it is necessary to comply with a legal obligation.

(c) Where it is necessary for our legitimate interests (to study how customers use and evaluate our products and services, to develop them and our business).

To improve the platform, products and services we offer, including to ascertain when there is increased demand for our services; to adapt our platform to the needs of all users; to recommend options that match any stated preferences; and to inform you of changes to our services.

Whenever necessary for our legitimate interests (to study how customers use our products/services, develop them, grow our business and inform our marketing strategy). To enable us to manage customer service interactions with you. To understand how our customers use our products and services and improve our business). To keep track of your relationship and purchase history with us. To verify your identity and identify and prevent fraudulent transactions.

Marketing

We strive to provide you with options regarding certain uses of personal information, particularly for

marketing and advertising. You will receive marketing communications if you have requested information about our services or purchased products or services from us and, in each case, you have expressly

consented to receive that marketing.

Before we share your personal data with any company we will require your explicit consent for acceptance-

In the event that you choose not to receive these marketing messages, this does not apply to personal data provided to us as a result of a purchase of products or services, experience of products or services or other transactions (which we will continue to process in order to perform a contract with you or as a result of our regulatory or legal obligations).

5. WHO WE SHARE YOUR PERSONAL DATA WITH

Access:

You have the right to request a copy of the personal information Mobbi holds about you free of charge, however we may charge a “reasonable fee” if we believe the request is unreasonably burdensome, to help us cover the costs of locating the information you have requested. We reserve the right to respond to your request as soon as possible and (except in certain circumstances) within one month.

Correction: If there are any inaccuracies in the information we hold about you, please contact us so that we can correct them.

Deletion: If you feel that we should no longer hold or process your personal data, you may request that we delete it. Please note that this may not always be possible due to legal obligations. Use restrictions: you can request that we stop processing your personal data if: (i) if its accuracy and correctness is disputed (unless accuracy is verified); (ii) if the processing is contrary to law; (iii) if it is considered that we no longer need your personal data for the purposes for which it was collected, except that we still need your data to initiate or defend against a claim or lawsuit; or (iv) you object to the processing and we are investigating whether it is legitimate to process your personal data despite your request.

You have the right to object to the processing of your personal data if there is a legitimate interest (or that of a third party). You also have the right to object to the processing of your personal data for direct marketing purposes.

Request for transfer: If you wish to transfer your personal data to another organisation (and certain conditions are met), you can ask us to do so and we will send it directly if we have the technical means to do so. Please note that this right only applies to automated information for which you initially gave consent or where we have used the information to perform a contract with you.
